Trademarks and service marks are used to ascertain goods (works/services) sold (performed/provided) by a legal entity or an individual.
What is the difference between trademark (“torgovaja marka”) and product mark (“tovarnyj znak”)? Both terms are used to denote one and the same intellectual property unit which can also be called a company’s brand or logo. Russian legislation, however, requires that the term “product mark” be used. In Western countries, “trademark” is far more common. The principal right a trademark owner acquires by registering his/her trademark is the right to prohibit others from using it.
There are three basic types of trademark:
- Verbal trademark (a word)
- Graphic trademark (a picture, an image etc.)
- Combined trademark (a picture and a word).
Trademark registration proceeds in the following steps:
- Consultation on issues related to registration and patentability of the trademark.
- Verification of trademark "authenticity" by comparing it with registered and registration- pending trademarks.
- Preparation and submission of an application to the Federal Institute for Industrial Property (FIPS).
- Handling paperwork related to the application, keeping up correspondence with the FIPS.

In some cases, it may take some additional steps to complete the registration procedure. That is why the final cost of trademark registration often differs from the originally calculated amount.
Trademark patentability verification is an optional step. However, it will save you time and money in case there is a registered or registration pending trademark that resembles yours to the point of confusion.
Trademark registration procedure can be either standard or compact. In a compact procedure, there is a special agreement concluded with the FIPS. The agreement stipulates that the FIPS will perform compact registration for a separate fee (around 9000 RUR).
